PROJECT INSURANCE

You may belong to any of the following categories - Government Linked Companies, Developers, Main Contractors or Designers. Your main concerns are different from the other buyers of insurance. This is because each party would have a risk they cannot afford to take and are looking at transferring that risk to insurers by way of purchasing insurance. For example, the project owner is keen to control the claims proceeds in the event of an insured event happening. On the other hand, a Main Contractor may be interested to cover design failure once he had received the responsibility of a Design and Build contract. We will be able to tailor make the correct response to your needs.

TYPES OF POLICIES

COMPREHENSIVE GENERAL LIABILITY

The CGL Policy is a liability insurance that covers businesses against the risk of lawsuits from third parties. These lawsuits can arrive following property damages or bodily injuries that the policy holder causes to third parties. The CGL can be extended to cover additional insured parties, contingent non owned and hired vehicle liability, and damage to principal existing property as well as sudden and accidental pollution.
It can also be extended to cover waiver of subrogation and also contractual liability.
Many of our clients who request this are from the Oil and Gas industry.

PUBLIC LIABILITY (PL) INSURANCE

The PL provides cover to your legal liability to third parties as a result of an accident in connection with your business operations.
Circumstances covered by the policy are bodily injury, illness and loss of or damage to property. As well, costs and expenses of litigation can also be covered.

CONTRACTOR’S "ALL RISKS" (CAR) INSURANCE

CAR policy provides protection during the course of construction of works and for an adequate maintenance period. The coverage granted will not only protect the physical building, construction risks, tools, plant and equipment but will also protect against claims made by other parties for injuries or property damage, due to your negligence or that of your work force.
This Policy offer coverage for sudden and unforeseen damage as a result of fire, lightning, explosion, flood, inundation, windstorm, earthquake, theft, collapse, lack of skill, erection faults, malicious damage, riots, strikes and civil commotion to:

  • the temporary and permanent works as per the contract until hand-over to principal
  • materials on site in connection with the works as well as those in a locked container on site
  • construction plant, machinery, equipment and property on site for the purpose of the contract

The risks to public liability are also covered in the form or legal liability for bodily and injury to and property damage of third parties, arising during the construction period and maintenance period
The CAR policy covers loss or damage of contract works. Third party risks are also covered in connection with the project. The sum insured and the duration of cover, including maintenance period or defects liability period would be as per the letter of award.
Removal of debris, professional fees, contractor’s plant and equipment as well as principal’s existing property can also be covered.

CONTRACTORS PLANT AND MACHINERY (CPM) INSURANCE

The CPM policy provides cover for plant and machinery used by contractors at site for various projects. When electing a sum insured, we must take into account freight, custom duties and cost of erection. The policy covers repair or replacement cost from any cause not excluded.

ERECTION “ALL RISKS” (EAR) POLICY

Like the CAR policy, this EAR policy covers loss or damage of contract works being constructed. Third party risks are also covered in connection with the project. The sum insured would be the figure mentioned in the letter of award.

However, since the machinery content in the works is high for some projects, testing and commissioning are also covered especially for new items.

CIVIL ENGINEERING COMPLETED RISKS (CECR) INSURANCE

Civil Engineering Completed Risks (CECR) insurance is designed to provide an all-risks cover for civil engineering structures after their completion should they be exposed to fire hazards, natural catastrophes or any other perils as extended in the policy. This type of insurance coverage is often purchased for highways, bridges, jetties, etc.
The following perils are covered, amongst others – fire, lightning, explosion, and impact damage by vehicles including water borne vehicles, impact of aircraft, earthquake, tsunami, storm, flood, inundation, wave action, water, subsidence, landslide, rockslide and vandalism.

THE SINGLE PROJECT PROFESSIONAL INDEMNITY INSURANCE (SPPI)

The Single Project Professional Indemnity policy provides cover for a professional on a project basis. As such, the policy would be dedicated for a particular project only. There is no requirement to tie the coverage period to the construction period or including maintenance period, and often we have to cover the client based on their contractual requirement. This can be for a period of say 8, or even 10 years.

ADVANCE PAYMENT BOND (APB)

The APB is required when a contractor applies for an advance payment from the Principal to help fund the startup cost of the project. The bond then guarantees the contactor is able to make repayments for the advanced money. Normally a principal would make deductions from progress payment to ensure the contactor repays the advanced moneys.

TENDER BOND

Sometimes a principal require the contractor to submit a tender bond to ensure the contractor submits a bona fide tender and is capable of providing a PB in the event that the tender is accepted by the Principal.

FOREIGN WORKER INSURANCE GUARANTEE

The FWIG is a guarantee that is required by the Government (Immigration department) from employers as a security deposit when employers hire foreign workers in various sectors.
The immigration department predetermines the guarantee period and the amount of guarantee. This would range from 13 weeks to 36 months for between RM 250 to RM 3,500. Commonly, 18 months is asked for. This FWIG will be called for by the immigration department if the repatriation of workers becomes necessary.

WORKMEN'S COMPENSATION (WC) INSURANCE

The WC policy covers your statutory liability under the WC laws (The Workmen’s Compensation Act 1952) and common laws to your employees who are not covered by SOCSO.
The policy provides cover against all sums you are liable to pay to any employee for personal injury sustained by accidents or occupational diseases out or in the course of employment under the 2 law mentioned above.
